24 May 2013 - Today, the Constitutional Court of Bosnia and Herzegovina, at its 80th plenary session, considered several requests for review of the constitutionality and a large number of appeals on alleged violations of human rights and fundamental freedoms.

Inter alia:

The Request of the Serb Caucus in the House of Peoples of the Parliamentary Assembly of Bosnia and Herzegovina is dismissed, whereby, inter alia, it is sought that the Constitutional Court of BiH establish that the Law on Pension and Disability Insurance of the Federation of Bosnia and Herzegovina is not in conformity with the Constitution of BiH as it does not grant the right to the pensioners from the territory of the Federation of BiH, who had moved to the Republika Srpska during the war and did not return to the territory of the Federation of BiH after the war but still live in the Republika Srpska, to submit the request for pension with the insurer in the Federation of BiH. As regards the allegations from the Request of the Serb Caucus in the House of Peoples of the Parliamentary Assembly of Bosnia and Herzegovina, the Constitutional Court of BiH found that the Law on Pension and Disability Insurance (Official Gazette of the Federation of BiH nos. 29/98, 49/00, 32/01, 61/02, 73/05, 59/06, 4/09 and 55/12) is in conformity with the Constitution of Bosnia and Herzegovina.

The Constitutional Court of BiH granted the appeal of Živko Budimir as it found that there is a violation of Article II(3)(d) of the Constitution of Bosnia and Herzegovina and Article 5 (1)(c) of the European Convention for the Protection of Human Rights and Fundamental Freedoms.

The Decisions of the Court of Bosnia and Herzegovina no. S1 2 K 012709 13 Kv of 3 May 2013 and no. S1 2 K 012709 13 Krn3 of 27 April 2013 are quashed and the case is remitted to the Court of Bosnia and Herzegovina which is obligated to immediately adopt a new decision in accordance with Article II(3)(d) of the Constitution of Bosnia and Herzegovina and Article 5 (1)(c) of the European Convention for the Protection of Human Rights and Fundamental Freedoms.

The Court of Bosnia and Herzegovina is ordered to inform the Constitutional Court of Bosnia and Herzegovina, within 8 days as from the date of delivery of this Decision, about the measures taken in order to enforce this Decision, in accordance with Article 74(5) of the Rules of the Constitutional Court of Bosnia and Herzegovina.

The Constitutional Court of Bosnia and Herzegovina rejected as inadmissible the appeal of Živko Budimir filed against Decisions of the Court of Bosnia and Herzegovina no. S1 2 K 012709 13 Kv of 3 May 2013 and no. S1 2 K 012709 13 Krn3 of 27 April 2013 with regards to Article II(3)(e) of the Constitution of Bosnia and Herzegovina and Article 6 of the European Convention for the Protection of Human Rights and Fundamental Freedom for being premature.

All decisions adopted at the session will be delivered to the appellants within one month and published at the website of the Constitutional Court of Bosnia and Herzegovina.
